Terms of Service

1. Acceptance of Terms

By accessing or using Kipstats ("the Service"), operated by KIPDEV SAS, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Kipstats is a privacy-friendly web analytics platform that allows users to track website traffic without using cookies or collecting personal data from visitors. The Service includes a tracking script, a dashboard, and related APIs.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use

4. Plans and Billing

Kipstats offers Free, Pro, and Agency plans. Paid plans are billed monthly via Stripe. By subscribing to a paid plan, you agree that:

  • Charges are recurring until you cancel your subscription
  • You can cancel at any time via the billing portal; access continues until the end of the billing period
  • Refunds are not provided for partial billing periods
  • We reserve the right to change pricing with 30 days' notice

5. Usage Limits

Each plan includes specific limits on the number of websites and monthly pageviews. If you exceed your plan's limits:

  • Additional pageviews may be rejected until the next billing cycle
  • You may upgrade your plan at any time to increase limits
  • Pageview counters reset on the 1st of each month

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Send artificially inflated traffic or pageview data
  • Resell or redistribute the Service without authorization
  • Interfere with or disrupt the integrity of the Service

7. Intellectual Property

The Service, including its design, code, logos, and documentation, is the intellectual property of KIPDEV SAS. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Your analytics data remains your property.

8. Data and Privacy

Kipstats is designed to be privacy-friendly and does not use cookies or collect personally identifiable information from your website visitors. For details on how we handle your account data, please refer to our Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, KIPDEV SAS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your account settings. Upon termination:

  • Your access to the Service will cease immediately
  • Your analytics data will be permanently deleted within 30 days
  • Active subscriptions will be cancelled

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Applicable Law

These Terms are governed by the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Bordeaux, France.
